Netmusketeer Acceptable Use Policy (AUP)

Introduction

Netmusketeer is committed in protecting its users and employees from harassment or illegal acts. Netmusketeer strives to comply with all the laws concerning Internet use.

The customer, in using Netmusketeer service, acknowledges this Acceptable Use Policy (AUP).

Netmusketeer may modify the stipulations in this AUP without the need to give prior notice to customers. Customer accepts any changes in the terms once it is published on the web.

Scope

This AUP covers the Netmusketeer services such as hosting, web designing, web packages, content, and software applications, and other related services on website development.

Prohibition

General

Netmusketeer prohibits users or customers from using its services for illegal or harassment acts. It includes activities that disrupt work operations or cause undue hardship to the company. Examples are acts that violate intellectual property rights of others, posting or sending offensive material, spamming or abusing email usage, and causing security threats or physical harm.

This prohibition on harassment, abusive, and illegal acts covers Netmusketeer services in web hosting, communications, web development, service turn over, and maintenance.

Failure to comply with the above stipulations constitutes violation of this AUP and has

corresponding penalties under governing laws.

Unlawful Activities

Netmusketeer IP Services must not be misuse or associated with any illegal act that violates existing local or international law. It includes any violation on governing criminal, administrative, or civil law in Philippines and abroad.

Infringement of Intellectual Property Rights

All and any of Netmusketeer content, graphics, images, and icons must not be

misuse for redistributing, copying, rewriting, reproducing, or re-transmitting that constitutes violation of copyright or intellectual property rights of the company or any user/ customer/ private user.

Netmusketeer also includes prohibition on violation of existing trademark/ patent/ privacy law.

Threatening Material or Content

Netmusketeer IP Services (its content, images, graphics, or icon) must not be misuse to harass or harm users/customers/ private group or identity. Also, Netmusketeer IP services must not be used to cause disruption to operations or cause undue hardship to management.

Netmusketeer reserves the right to monitor contents/images/graphics on websites, which customers have bought to the company for the purpose of screening violations to intellectual property rights, patent, trademark, harassment, discrimination, or criminal laws. 

Unlawful Acts with Minors

Netmusketeer management prohibits all and any unlawful acts towards and with minors. Netmusketeer reserves the right to screen websites bought with the company for the purpose of monitoring acts of exploitation and abuse. Netmusketeer complies with existing protection laws on minors, including reporting cases of abuse or

exploitation to proper authorities.

Email Abuse

Netmusketeer prohibits users/ customers from misusing the free email accounts in activities of spamming that may harass/threaten/ or cause disruption to another party's operation or welfare.

The management also prohibits associating, misusing, or relating Netmusketeer's email accounts to acts of "mail bombing" or unauthorized file transfer.

Netmusketeer reserves the right to block or terminate its email accounts, including those given to customers who bought website package.

Specifically:

The email should only be used by the individual entrusted with it and should not disclose to anyone its technical properties, connection details and its security settings.

The user should only use or access the email on a trusted location and secured connection so as not to compromise its security.

Email should not be used in distributing or propagating images, text or materials that can be considered indecent, pornographic, illegal or something that signify discrimination on race, religion and gender.

The email should not contribute in retrieving of copyrighted information that can further lead to violation of the copyright itself.

The email should not be used in a manner that could encourage intrusion or unauthorized access on another organization's mailbox system.

The email should not be used in undertaking activities both intentional and accidental that could potentially waste staff effort or networked resources.

The email should not be used as a medium in contacting any form of computer virus

or malware into the corporate network. 

Security Violation

Customers are deemed responsible for safeguarding their systems and the equipments that connect to Netmusketeer IP Service.

Users/ Customers/ Private entity or group must not attempt to access Netmusketeer's network/system for the purpose of hacking, breaching, installing virus, phishing, or causing threat that may impede, distract, damage, or cause undue hardship  to the company. It includes any act that attempts access to Netmusketeer's network/system with the purpose of maliciously retrieving and misusing information.

The user/customer releases Netmusketeer from any liability arising from any incident of misuse/ assault from any third party. The user/customer waives his or her right to file claim arising from liability incurred from damage or misuse of one's bought website or functions.

Customer Responsibilities

Users/ Customers are deemed responsible for the content/images/graphics that are uploaded/ downloaded on websites. Netmusketeer waives responsibility for any acts of customers who avail of its services.

Any content/image/link to and fro Netmusketeer's main website does not necessary reflects the management's opinion.

Customers have the responsibility to report cases of abuse/ misuse of their bought website from Netmusketeer and carry the obligation to support the prevention of related cases.

Enforcement

Users/ customers who violate the terms stipulated above accepts the consequence of undergoing disciplinary measure/s from Netmusketeer management, ranging but not limited to warning, termination, or legal action.

Netmusketeer may send notice of action through email, phone, or any means calling the user’s/ customer's attention to correct offensive/ unlawful act at the soonest possible time.

Netmusketeer reserves the right to adhere to court or government orders that reasonably proves or shows the user's/customer's violation of existing law/s; or when

Netmusketeer determines reasonably a wrongful conduct/act on the part of user/customer, compelling the management to suspend or terminate the user/customer account promptly without notice.

Specifically, Netmusketeer may suspend or terminate user/customer accounts that:

1. Cause Netmusketeer to be unnecessarily involved to unlawful acts, exposing the management to potential penalty from authorities or governing bodies.

2. Disrupts, interferes, damage Netmusketeer operations or causes undue hardship on the part of the management

3. Harasses/ discriminates/ threatens/ disrupts the normal operations or activities of another user/ customer.

4. Causes safety risk to other private identity/ groups or third party. 

Case Report

Any violation of the above stated terms must be properly addressed to info@netmusketeer.com. Aggrieved party or defendant may include statements on how Netmusketeer may assist in the investigation or arbitration process.

Though Netmusketeer may help in resolving complaints and grievances, the customer/user/ any party agrees with this AUP that the management is free from any liability arising from any use or misuse of its services or website.

Complaints regarding plagiarism/ patent/ trademark violations may be sent in formal writing to info@netmusketeer.com

Users/ Customers/ any third party has the responsibility to update his or her contact information that may help in prompt processing of complaints/ claims.

Netmusketeer management reserves the right to fully enforce all the above mentioned stipulations and correspond to governing laws both locally and internationally.

Netmusketeer reserves the right to make changes on this AUP with or without prior notice to concerned parties.

Netmusketeer Terms of Service (TOS)

Netmusketeer Terms of Service (TOS)

This Terms of Service (TOS) is between you, our client, and Netmusketeer. By receiving and reading this Terms of Service (TOS), you accept the terms and conditions stipulated herein.

Client of Netmusketeer has the responsibility to access updated TOS of Netmusketeer. Client, who receives this TOS through email or by notification in the www.netmusketeer.com site, has the responsibility to express agreement or disagreement within 5 days. Failure to respond within the given period means acceptance of the client of the following terms and conditions.

1. Services

Netmusketeer provides website designs, content, and web administration services. Services may include web development support, additional applications, and e-commerce functions. Netmusketeer may constantly communicate with active client through email, phone call, and other means to facilitate and clarify purchase and transactions. The client shall provide all equipment needed to reach Netmusketeer IP Services.

2. Electronic Communication

The client agrees to receive correspondences from the client through email, letter, or any electronic communication device in the processing of order or transaction. The client has the responsibility to constantly check available or provided email in updating agreements and transactions.

3. Privacy

Netmusketeer protects its clients from suspicious and malicious entities that may harm or interfere with the existing business of the client or the management. Netmusketeer keeps client information and treats correspondences as confidential. The client agrees to treat all access information to Netmusketeer IP Services as confidential as well.

4. Call recording

Netmusketeer records and may monitor all calls to and from clients for the purpose of verifying orders, transactions, or information within proper and authorized personnel. Netmusketeer strives to provide excellent and accurate service through constant monitoring or professional communication to client. The client hereby is aware and agrees with such call recording and monitoring process of Netmusketeer.

5. Unlawful Practices

Netmusketeer complies with existing local and international laws on acceptable practices in the internet. Netmusketeer also strives to protect minors, women, elderly, and clients from abusive, discriminatory, and malicious actions or practices from users, other clients, or third party. The client agrees to not engage in the following unlawful practices:

a. Posting sexually explicit or oriented materials such as photos, graphics, or content.

b. Posting images, graphics, or content that exploits or abuse minors.

c. Posting images, graphics, or content that discriminates a particular race/ethnic/ religion/ gender/ age/ disability.

d. Sending spam emails or engaging in activities such as "mail bombing", phishing, hacking, or cracking.

e. Creating and spreading computer viruses or malware to co-users, clients, or within Netmusketeer IP Services.

f. Sending offensive comments, content, and images to other users/clients/third party such as racial slurs, obscene remarks, threats, slander, and sexually-harassing language.

g. Comments that contain hate, revenge, or defamatory language that offends, harasses, or threatens the safety and general welfare or users/ clients/ other parties.

h. Posting, commenting, distributing photos/content/graphics on illegal drugs.

i. Unwarranted linking of Netmusketeer site to other sites, especially on sites that are involved in sexual profanity, exploiting minors, drug and substance abuse, racial/age/gender/religion/disability discrimination, and other illegal activities.

The client agrees to be responsible, lawful, and professional in posting images, graphics, content in bought and created website from Netmusketter as well as in engaging with other users/clients/third parties.

The Netmusketeer management may monitor or screen contents/images/ from the clients/users website for the purpose of ensuring compliance of all concerned parties with governing laws on acceptable internet use.

6. Intellectual Property Policy

Netmusketeer upholds intellectual property rights of users/customers/all parties concerned. Netmusketeer observes applicable laws on trademark/patent/copyright and trade that directly or indirectly affects internet activities.

Netmusketer may warn/suspend/terminate accounts that violate any of the existing intellectual property laws locally and internationally. Netmusketeer may or may not provide prior written warning on the termination given that the violation has been determined as unreasonable or poses harm to other parties.

Clients who avail of Netmusketeer website services accepts responsibility on verifying that content/photos/videos/images/graphics submitted for web publication is free from plagiarism and does not violate copyright/trademark/patent/trade rights of others.

Clients also accept responsibility on obtaining permission from rightful authors/owner/holder of original material/work. The Client accepts full liability for any copyright or intellectual property law infringement/ complaint/ case arising from one's own bought website from Netmusketeer.

All website designs, content, graphics, applications that Netmusketeer will create and domain name that will be bought for the client will remain as the property of Netmusketeer until the client settle all fees and all agreed terms.

7. Netmusketeer Services

Netmusketeer provides Website Design, Content, and Website Administration services.

In Website Design service, the client will receive fully-functional site equipped with graphics, plug-ins, or e-commerce features depending on the package chosen.

In Content service, the client will receive textual material for the website purchased, including slogans, banner campaign headlines, profile text, and related content for the allotted pages.

In Website Administration Services, client will receive technical support and web development assistance throughout the project phase or until the client and the Netmusketeer management deemed so.

For the Basic package, features include:

a. 3 Pages Website

b. 1 GB Disk Space

c. 150 GB Bandwidth

d. Free hosting and domain

e. 3 Email accounts

f. UP Time Support

The Basic package provides client with 3-page website that is powered with sufficient storage to house photos and content. Netmusketeer will take charge of the domain name registration. Client will receive three professional email accounts. Netmusketeer will take charge of the web administration tasks.

For the Premium package, features include:

a. 5 Pages Website

b. 2 GB Disk Space

c. 200 GB Bandwidth

d. Free Hosting and Domain

e. 5 Email Accounts

f. UP Time Support

The Premium package provides client with 5 pages to feature more products/ services. Client will be able to upload more photos, video presentations, and blogs. Client can request applications in utilizing social media functions.

Netmusketeer will provide five professional email accounts, and will take charge of the web administration tasks.

For the Custom package, features include:

a. 5+ pages website

b. 2 GB Disk Space

c. 300 GB Bandwidth

d. Free Hosting and Domain

e. 10 Email Accounts

f. UP Time Support

The Custom package provides client with more than five pages of website, powered with mega data storage and graphics capability. It includes e-commerce functions, complete with shopping cart and PayPal action buttons.

Netmusketeer will provide IT assistance on utilizing applications and managing pages. 

The client may choose the package that is deemed appropriate for one's type of business/organization/hobby. Client may opt to customize the service and Netmusketeer may arrange the price starting from $499 + $50 monthly. Prices for the other two packages are discussed in Section 9.

Once the client has stated the desired package, the agent will prepare an account summary and a receipt will be sent to the client through email. Once the "Account Summary" has been sent, it is regarded as official and fees agreed will commence.

Changes in the selection of package will require correspondence with the Account Manager or should be settled within the pre-order period. Charges may apply for sudden changes on package selection as determined by Netmusketeer management. This is to cover the expenses occurred in booking web designer/content writer/ web administrator or for related expenses in starting the website project.

Netmusketeer reserves the right to add or modify the services published in www.netmusketeer.com for the purpose of improving the quality of services and upholding standards required by international regulation bodies.

8. Website Creation Process

Netmusketeer implements the following procedure for website creation purchased from www.netmusketeer.com:

a. The Client may receive email/ phone call/ or any correspondence in communicating Netmusketeer website development services.

b. The client is instructed to visit www.netmusketeer.com to view sample designs, in which the client may choose the most appropriate design for one's business, organization, or hobby.

c. The Netmusketeer agent or personnel will guide the client in the packages available.

d. The client may select the payment modes available.

e. The client will then receive transaction receipt and written summary of the new account through email or form determined by Netmusketeer management.

f. The client will then need to send appropriate materials to start creating the website.

g. The client can expect to see the website live after 7 days or at the time determined by the management, depending on the complexity of the project, especially those with CUSTOM package.

The client accepts responsibility to send the necessary information/materials on the company/organization/hobby to be featured on the website immediately for Netmusketeer to fulfil the 5-7 days web creation deadline. If the client has no available content or design materials yet, relaying of company/organization/hobby/personal web design vision should be communicated to the agent within the pre-order period.

The information/materials include the following:

a. Company/organization/hobby/personal Profile

b. Company/organization/hobby/personal Contact and credit information

c. Company/organization/hobby/personal Vision, Mission, Goals

d. Company/organization/hobby/personal pertinent Background Information

e. Company/organization/hobby/personal Purpose for Setting up the website

f. Company/organization/hobby/personal Design vision or marketing materials

g. Company/organization/hobby/personal Related Content

h. Company/organization/hobby/personal E-Commerce credit information and needed functions

i. Company/organization/hobby/personal needed applications/ plug-ins

Should the client delay or fail to provide information or design vision to Netmusketeer, resulting from the web designer's delayed work on the project; the client accepts to still pay agreed fees occurring from the date of purchase, including expenses such as on domain name, set-up, and programming.

Netmusketeer may provide the design conceptualization and content upon the request/ order of the client. It may include logo creation, banner design, slogans, write-ups, editing of profile textual content.

Netmusketeer may charge additional fees for website needing/requesting bulk/complex content or design.

All requests/orders for additional content/design must be properly coordinated with the agent/account manager, preferably within the early stage of the account.

Netmusketeer reserves the right to refuse additional requests for content/design when the website construction has already started, or when the request is beyond Netmusketeer’s scope of services. Also, when such request violates existing rights or laws locally or internationally.

Netmusketeer strives to deliver website order within 5-7 days, but does not guarantee it for orders demanding complex features, especially for CUSTOM package.

9. Payment Terms

The client accepts the responsibility to pay agreed amount on purchased Netmusketeer services/packages. For Basic package, the amount is $299 + $50 monthly; For Premium package, $399 + $50 monthly; For Custom package, the price starts at $499 + $50 monthly. The price may vary per client/ service/customized order, or as determined by Netmusketeer management.

Netmusketeer reserves the right to implement changes in the prices with or without notice from the users/ customers.

Clients may pay through the assigned PayPal/merchant/credit account or any channel approved by Netmusketeer. Clients may call the toll free hotline 1-855-LOTWEBS/ 1-855-5689327 to be guided through the payment procedure.

The client accepts that information/instructions on how the purchased website should appear must be arranged in the pre-order period. Netmusketeer will send through email an account summary of the order, indicating the date when the website creation will start.

The client will see, "Account Started", on the Summary, usually it also marks the start of the website creation because the account summary information has been forwarded to the client and also to the web designer who will perform the task. Once the "Account Started" has taken place and the web designer has taken the project, the client will have to fulfil all financial obligations.

The client will have to pay the agreed amount reflected on the "Account Summary" and any changes on information/instructions on web design/content shall have corresponding charges as determined by Netmusketeer management.

The client is therein advised to complete all relaying of information to the agent within the pre-order period or while the agent is processing the order through phone/email/ correspondence. Netmusketeer reserves the right to refuse requests from those accounts that have not generated proper and prompt responses, and the client will still have to pay for expenses that already incurred by Netmusketeer arising from purchase of domain name and operations on set-up and programming.

Netmusketeer reserves the right to collect financial information from the client related to the payment of Netmusketeer services. Information may include credit card details, merchant account details, or how the client may pay Netmusketeer for services rendered.

Netmusketeer reserves the right to pursue arbitration or legal action for delinquent or fraudulous accounts.

10. Client Approval

Client accepts responsibility for checking/ verifying websites, which are turned over by Netmusketeer. It includes testing the features, plug-ins or applications, and or e-commerce action buttons.

The client accepts obligation to respond to Netmusketeer's notification that the website order has been completed. The client has five (5) days to respond to Netmusketeer's email/phone call/ any other form of communication. Should the client failed to respond within the given timeframe, Netmusketeer may take the website live and corresponding charges will take effect.

The client understands that should there be any missing information in the client portfolio, which directly affects textual/graphical completion of website work; Netmusketeer will send a notification to the client, in which the latter must respond within five (5) business days. Should the client fail to respond within the given period, Netmusketeer may take the website live, leaving the missing information "as-is".

11. E-Commerce

The client is responsible for checking/ verifying the e-commerce action buttons in one's website immediately after turn-over. The client is still responsible for ensuring the functionality of one's PayPal/merchant account that has been set up in the website.

Netmusketeer will send notice of e-commerce set-up completion, and the client has to respond within five (5) business days. Should the client fail to respond within the given timeframe, the website is deemed approved by default and will be taken live by Netmusketeer.

Should there be any malfunction in the e-commerce buttons, and it is reported within the 5-day notice; Netmusketeer will assist the client in troubleshooting, but the client has to deal with his/her own PayPal/merchant account functionality.

Netmusketeer will give guidelines and assistance on how to utilize the e-commerce features. Should the client requests Netmusketeer to input product/service data into the e-store, the management may charge additional fees depending on the bulk of data or complexity of task.

12. Additional features or applications on website

Client may request additional plug-ins or applications on purchased website. Corresponding charges will apply depending on the package selected and the cost of the additional feature. Netmusketeer reserves the right to determine the value of additional features as services.

13. Technical Support

Netmusketeer provides technical support to its clients within the contract period. Any further assistance from Netmusketeer's IT team will have corresponding charges as determined by management.

14. Domain Name

Netmusketeer provides domain name as free when the client purchased Basic, Premium, or Custom package. Netmusketeer takes charge of obtaining the domain name for the client. The domain name obtained by Netmusketeer remains its property until the client settles all financial obligations.

When Netmusketeer determines that the client has settled all financial obligations, the management may transfer the rights for the domain name to the client. Once the transfer take place, Netmusketeer will no longer be responsible or be held liable for any transactions or obligations that will occur from the maintenance of the domain name.

During the pre-order period, Netmusketeer guides the client in selecting the best domain name for one's website. The agent and client may opt to come up with three options. The agent may select the availability of such domain names and the pertinent information about it, the client then will choose which one is to be taken as official domain name.

Should the desired domain name is no longer available; the client may opt for an alternative domain name to be purchased by Netmusketeer.

Once Netmusketeer has obtained the selected domain name, the client may no longer cancel it.

Should the client fail to fulfil financial obligations to Netmusketeer, the domain name will remain as property of Netmusketeer and will not be transferred to the client.

Netmusketeer reserves the right to cancel, renew, transfer, re-sell, or maintain domain names that are still within its authority or are still its property. Netmusketeer will send notice of the domain name status to the client and the latter must respond in writing within five (5) business days.

15. Billing Terms

Payment for Netmusketeer Services takes effect from the time the Account Summary is sent to the client and a receipt copy is kept by the management. This includes payment for the package selected and or additional services requested.

Once the client receives the Account Summary, the client is responsible for paying the fee stated. The Netmusketeer management will then send a receipt copy of the payment transaction, and a notice that work on the project has officially commence.

Client agrees that Netmusketeer will not start work on the project until a receipt copy of the payment transaction and Account Summary has been received and approved by both parties.

Clients, who have availed the monthly maintenance service, must pay the agreed amount before or on every 30th of the month.

Should the client decide to stop the monthly maintenance service; the client must send a written letter to Netmusketeer management. Take note that the request for termination of monthly maintenance service will have to undergo a 30-day process. This means that the monthly maintenance service will only stop after 30 days from the day the request letter is sent and received by Netmusketeer management. Netmusketeer does not and will not refund any amount of money should the client requests/argues that the 30-day period be not served.

The client agrees to pay all amount owed to Netmusketeer. Netmusketeer management reserves the right to pursue legal action once the client fail to provide arrangement/ settlement for unpaid dues.

For clients who avail of monthly maintenance service, Netmusketeer may charge delinquent accounts with $5 penalty for each affected month. This means that clients who failed to pay before or on 30th of the month, that month will generate additional $5 charge for late payment. The penalty will continue until the client settles all dues.

Should the client consistently failed to pay financial obligations for three consecutive months; Netmusketeer will suspend/ terminate its services to the client and will pursue corresponding legal action. Netmusketeer may charge client for fees incurred from collection agency and or for expenses such as attorney fees.

If the client has any clarification/complaint/response to an existing account, formal written letter must be addressed to

and emailed to info@netmusketeer.com or sent through air mail at 6th Floor Unit B RCC Center 104 Shaw Boulevard Pasig City, Philippines 1603.

The client agrees to wait within 5-7 business days or within reasonable time for Netmusketeer Management to respond to such letter.

16. Refund Policy

The client accepts that Netmusketeer will not refund payments on set up fee or the package price for Basic, Premium, and Custom. This takes effect once the Account Summary has been sent to the client through email or a receipt copy has been kept by Netmusketeer. This means, once the client agreed with the details on the website project and its corresponding fees verbally and such agreement was written in the official Account Summary, no refund can be made.

Not even hours after the Account Summary was sent can nullify the payment agreement made between the client and Netmusketeer. The client may, however, choose not to proceed with the website project, but will still have to pay the agreed amount.

The No-Refund Policy is necessary for Netmusketeer management to cover loss in business opportunity, cost of domain name purchase, and cost in booking web designer/content/administrator/agent, and other up-front cost in the event that the transaction/project did not materialize.

If the client has ordered the monthly maintenance service along with the BASIC/PREMIUM/CUSTOM; Netmusketeer will only start charging for the monthly fee once the website was taken live.

Netmusketeer management will not refund the payment made for/on the 1st month of maintenance fee. This means, if the new client wants to cancel the monthly fee, but the Account Summary was already sent indicating order for such; Netmusketeer will not cancel the order and the client will still have to pay for it.

However, the client may send a written letter stating the intent to cancel the monthly maintenance service. The client will then have to complete the 30-day notice.

Example: A client who purchased a Basic package ($199) plus monthly maintenance fee ($50) wants to cancel the monthly fee the day after the Account Summary was sent on September 10, 2012.

Netmusketeer will collect payment for $199 as set up fee and will still collect the $50 after the website was completed.

Supposing the website was completed and was taken live on September 17, 2012, Netmusketeer will still do the 1st month maintenance service, and will collect payment due on October 17, 2012.

Netmusketeer, however, will no longer charge $50 for the month of November, and will cancel further monthly maintenance service.

This means that Netmusketeer will only charge for the billed 1st month and will stop on the requested cancelled 2nd month.

This policy is necessary to cover Netmusketeer's upfront expenses such as booking the web designer for the first month, securing server space, and loss of business opportunity.

The client understands and agrees with the above stated terms and releases Netmusketeer from any claims/liability that may arise in the course of transaction/ project.

The client agrees to pay agreed orders and accepts responsibility for any financial consequences that may arise in the course of transaction/ project.

Netmusketeer reserves the right to implement changes in the Refund terms with or without written notice to users/ clients.

18. Disclaimer of Warranties, Liability, Claims

The client releases Netmusketeer management, including its personnel, from liability arising from the transaction/purchase of Netmusketeer website services. The client accepts responsibility for the purchase/ use of Netmusketeer services, including communication/ transaction with third parties such as PayPal and bank entities.

The client accepts that Netmusketeer does not guarantee functionality of any of its services, including e-commerce features on the client's bought website, even the increase of sales/target market/ success of SEO service/ related marketing campaigns.

The client releases Netmusketeer from any liability that may occur when client's website was infected with computer virus or when data was corrupted given that Netmusketeer management and personnel has not executed any malicious action nor has nothing to do with the incident.

The client accepts full responsibility for safeguarding and securing one's website data/files/access/services. The client accepts responsibility in protecting one's access details, including credit information in PayPal or merchant account.

The client releases Netmusketeer from any liability that may occur from misuse or unwanted activities in one's PayPal and merchant account given that Netmusketeer management or its personnel has not acted maliciously nor has nothing to do with the incident.

Should Netmusketeer stop the charges as requested, the client releases Netmusketeer from claims. The client accepts that entering business transaction with Netmusketeer is at his or her own risk, and releases Netmusketeer from any product/service liability.

The client understands that Netmusketeer does not guarantee the functionality of any of its services and releases Netmusketeer management and its personnel from warranty obligations.

The client releases all rights to file claim against Netmusketeer and its personnel and acknowledges that entering business transaction with Netmusketeer is at his or her own risk and informed decision.

Should there be unavoidable complaints from the client, in which require proper and reasonable action; Netmusketeer will arrange arbitration to settle matters.

The client understands and agrees with all of the stated terms. The client accepts responsibility in fulfilling the terms stated.

Netmusketeer reserves the right to implement changes in this Terms of Service (TOS) at any time with or without written notice to users/clients/third parties.
